DORKAR .IN Terms of Use

SERVICE PROVIDER AGREEMENT

Service provider should follow the bellow terms and condition strictly.

A. Introuction:

SSS TECH (License no:091713272143475) maintain and operates a website (dorkar.in) , mobile application and related administrative services ( in all together a online platform) by which service receiver (Later identified as user) and can book a household service required. Related Service provider will review the user requirements and may be selected for required service by user. It needs to be noted that service provider is fully sole independent authority and never employed by SSS TECH. The bellow terms and condition builds a legally binding agreement between SSS TECH AND Service Provider. When a service provider access dorkar.in online platform the service provider acknowledges that it has read, understand and agree with the binding of terms and condition of the service provider agreement. The service provider declares and acknowledges that it is a solely independent to provide the services and not employed by SSS TECH. You are adopting two contractual agreements. a). With SSS TECH b). With User

You are acknowledging and certifying that you have read, understood and agree with the binding of service agreement.

C.CONTRACTUAL LINK BETWEEN THE PARTIES:

SSS TECH (WEB SITE: dorkar.in) is providing you an online technology platform which is a connecting tool between user and service provider. Through the booking system SSS TECH (dorkar.in) will receive a payment from service provider for providing the connecting platform. The payment will be made immediately after booking/ after completion of jobs. SSS TECH will provide TAX Invoice against the payment. The service provider is fully independent authority and serves directly to user. The service provider acknowledges that it is strictly independent and not an employee, contractor, agent, joint venture or franchisee of SSS TECH. The service provider strictly has not any authority to make any agreements, commitments, provide warranty on behalf of SSS TECH. The service provider is a fully independent party. It should maintain and follow all the Govt. statutory norms including taxation, labor laws, safety norms and others. SSS TECH will not be liable of any type of safety violation, social violation, taxation dispute or any other statutory disputes during service. Service provider will be solely held responsible to maintain all the said legal norms.

D. Job assignment:

User(customer) will post the booking with necessary description including nature of Job, time frame , address of work place etc. Schedule time will be displayed in range of time/ specific time. Service provider will check the opportunity based on their expertise as well as the suitability of booking. SSS TECH cannot provide any guarantee regarding the allotment of booking to service provider. It will depend upon the requirement and situation. Confirmation of booking will be provided by both sides from service provider and SSS TECH. After confirmation of booking by service provider, a contract agreement is formed directly between service provider and user. Service provider need to complete the booked works as per the service agreement. Service provider will submit the details (name, GOVT ID Card copy, Authorization from service provider and Mobile No etc) of the representatives who /whose will be avilalable to meet the service. If service provider wants to reschedule the service it needs to inform before 24 hour of original schedule time. The time period may be changed with the nature of work. The same will be decided by SSS TECH.SSS TECH may cancel/change the service provider for the schedule service and will be notified accordingly. SSS TECH has sole authority to change the service provider for any booking without any prior information to service provider.

E.Service and customer satisfaction:

Service provider need to accomplish the assigned service as per service provider agreement. Service provider acknowledges and certifies that it is solely responsible for the service provided. Service provider is also agree to indemnify and hold SSS TECH (WEB: dorkar .in) harmless against any claim, action, damage, loss, liability, cost, charge, expense or payment which SSS TECH may pay, suffer, incur or are liable for, in respect of the Services or any breach of the Service Agreement by the Business. When a service provider booked a service immediately he is declaring and certifying that it is fully licensed (AS required by the Govt. Law) and qualilified to provide the service as booked. Service provider acknowledges that it is agreed to furnish necessary documents (Personnel police checks, and Business licensees, permits and/or certifications) on demand from administrative authority. By understanding the service agreement it acknowledges that service provider is agreed to provide minimum guarantee (Minimum 7 days after satisfactorily completion of service) for the service it has provided. On customer/ uses complain service provider should re attain for restoration during guarantee period. In failure of restoration service provider need to take necessary action to satisfy the user/customer. SSS TECH will send a security code in User and service provider registered mobile no. Service provider and user need to match the same before attaining service. The same is mandatory to avoid the unauthorized activity.SSS TECH may decide other option on failure of SMS management. SSS TECH is providing an online platform to Service provider and customer/user. It is not possible or has not control the quality of service provided by service provider. But customer satisfaction is the most important requirement for SSS TECH. Service provider will provide a feedback report dully signed by user and service provider after completion of each and every service with photograph evidence. It is mandatory to complete the booked service in scheduled time frame. On failures to attain (Without prior information as agreed in Service agreement) the booked services, service provider may be penalized as per customer requirement and will be decided by SSS TECH. SSS TECH has absolute right to take decision on referred situation. The service provider is a sole independent authority. It bears sole responsibility for the payment of all compensation, benefits and expenses of any Personnel, and for all required payroll tax, income tax withholdings, and Workers Compensation as to Business and all persons engaged by service provider during the Services.

C.Customer Security POLICY:

Dorkar.in also reserves the right to refuse or cancel orders in scenarios like inaccuracies in pricing of service on website, service unavailability and for other deficiency. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order. Any promotional voucher used for the cancelled orders may not be refunded. If a SERVICE USER violates any of the below referenced rules, it will be taken as Fraudulent activity and Dorkar.in, in its sole discretion, may take any of the following actions: (a) Cancel the Posting/order; (b) Suspend/Limit the SERVICE USER’s Account privileges; (c) Necessary Action as per Country’s Rules and Regulations; (d) Necessary actions as per company’s policies. User Provide Wrong Information while making account or putting request including beneath focuses yet not restricted to Name, Mobile Number, Address, Pic. User Reproduce submitted Documents Misuse of another customer Phone/Email. User uses invalid email and phone no User won’t pay for a request User use different person’s identity to avail service Same User carry different identity to make account or spot request User Post any message, information which is in against of Country’s (Republic of India) any rules & regulations.

D.Customer Cancellation/Reschedule Policy:

Service needs to be served as per schedule. User / his representative should be available to receive the services within schedule time. If User needs to reschedule Service time, on that case user needs to inform before 24 hours. Otherwise user need to pay the appointment charges which will a reasonable percentage of total work value. Work area should be eco friendly and hygienic. In pandemic situation OR in unhealthy and unsafe working environment service may be cancelled automatically. User may send request to reschedule the required services minimum before 24 hrs of scheduled time. Dorkar.in will decide the rescheduling and will inform accordingly.

E. Promotional Code:

Promotion Code will be appropriate inside the offered time-frame. Any help under a certain promotion code should be served inside the offered course of events. No promotion code can be utilized after the valid time-frame. A user should take specific benefit under a promotional code within mentioned time period. One Promotional code will be enough even though products vary under same classification.

F.PAYMENT/FEES:

SSS TECH (WEB SITE: dorkar.in) is providing you a online technology platform which is a connecting tool between user and service provider. Through the booking system SSS TECH (dorkar.in) will receive a payment from service provider for providing connecting platform. The payment will be made immediately after booking/ after completion of jobs. SSS TECH will provide TAX Invoice against the payment. Dorkar.in will charge you a convenience expense (“Fee”- 10% of of total work value) for the Services given by dorkar.in to you. The Fee might be charged from you at the time of booking of services or upon the completion of service. In order to avail the service, once the customer books a service on dorkar.in, he will get an option to pay via Cash on Delivery or online after completion of service. In case of cash on delivery payment, user/customer will pay the fees directly to service provider . Service provider will pay the fees (10% of total work value) to SSS Tech after receiving payment immediately (online / offline) from customer. In case of online payment, user/customer will pay the total charges by online mode to SSS Tech account. SSS Tech will pay the service provider directly after deduction of SSS Tech charges on realization of payment from customer. The customer just needs to select pay online after completion of service. Such Charges and Fee will be inclusive of applicable taxes where legally necessary. Charges and Fee paid by you are final and non-refundable, except if in any case dictated by SSS TECH( dorkar.in) or required by the important Consumer Law enactment. Under the significant Consumer Law enactment, SSS TECH (dorkar.in) will respond accordingly to any request from a Third Party Provider to modify the Charges for a particular service. From time to time SSS Tech (dorkar.in) can modify the charges. SSS Tech having absolute authority and right to vary the charges. Service provider need to visit dorkar.in web site frequently to stay updated. When a service provider is engaged for a service, it means service provider is agreed to pay the fees decided by SSS Tech. If any service provider delays to pay the charges to SSS TECH after receiving the payment from customer may be penalized. SSS Tech has absolute authority to take legal action against the service provider on non payment of Fees.

G. REFUND POLICY

Service fees provided by Client to Service Provider or Dorkar.in are final and non-refundable. But in some cases dorkar.in support management team can take some decisions, if any investigation report find any issues like

Client fully paid for certain job but job canceled due to others issues.
Job has been served and customer cleared the bill. But dispute arises within warranty period
Client paid in advance but job served in less amount.

In case of refund Dorkar.in promo code will be provided to customer for availing services.

H.Representation and Behavior:

Service provider acknowledges it that the representative of service provider will be fully professional. All the communication should be service related. Any miscommunication from service provider resulting harmful for SSS TECH will not be allowed. On that case SSS TECH is eligible to take necessary legal action. The representative of Service provider will be well behaved and will maintain the professional manner.

I.Violation of use of dorkar.in platform:

Service provider will not use any data of dorkar.in site for other purpose without WRITING consent of SSS TECH AUTHORITY. All the data furnished in dorkar.in platform is the property of SSS TECH.

J. License:

You hereby grant DORKAR.IN a non-exclusive license to use, reproduce, edit and authorize others to use, reproduce and edit any of your Comments in any and all forms, formats or media. This Agreement shall begin on the date hereof. Our Terms and Conditions were created with the help of the Terms And Conditions Generator.(I) you won’t duplicate, circulate, or make subordinate works of the Website, Apps or its item in any medium without Dorkar.in earlier composed assent; (ii) you won’t adjust or alter any piece of the Website, Apps or its item other than as might be sensibly needed to utilize the Website, Apps or its item for its expected purposes; and (iii) you will in any case act as per the agreements of the Terms of Use and as per every single appropriate law. Parts of this website offer an opportunity for users to post and exchange opinions and information in certain areas of the website. DORKAR.IN does not filter, edit, publish or review Comments prior to their presence on the website. Comments do not reflect the views and opinions of DORKAR.IN,its agents and/or affiliates. Comments reflect the views and opinions of the person who post their views and opinions. To the extent permitted by applicable laws, DORKAR.IN shall not be liable for the Comments or for any liability, damages or expenses caused and/or suffered as a result of any use of and/or posting of and/or appearance of the Comments on this website. DORKAR.IN reserves the right to monitor all Comments and to remove any Comments which can be considered inappropriate, offensive or causes breach of these Terms and Conditions.You warrant and represent that: • You are entitled to post the Comments on our website and have all necessary licenses andconsents to do so; • The Comments do not invade any intellectual property right, including without limitation copyright, patent or trademark of any third party; • The Comments do not contain any defamatory, libelous, offensive, indecent or otherwise unlawful material which is an invasion of privacy

K. INDEMIFICATION:

Service provider shall defend, indemnify and hold harmless SSS TECH and its affiliates and their officers, directors, employees, agents, successors, and assigns from and against all losses, damages, liabilities, deficiencies, actions, judgments, interest, awards, penalties, fines, costs, or expenses of whatever kind (including reasonable attorneys’ fees) arising out of or resulting from: (a) bodily injury, death of any person, theft or damage to real or tangible, personal property resulting from Business’s acts or omissions; and (b) Service provider’s breach of any representation, warranty, or obligation under this Agreement and the Service Agreement.

L.Risk and Insurance:

Service provider is full and sole responsible to identify the work hazards and also solely responsible to take necessary safety precaution to accomplish the service. Service provider acknowledges that it will provide sufficient compensation to their work force as per Govt norms. Necessary insurance policy whatever is required as per statutory norms will be maintained by service provider. SSS TECH will not be liable to maintain the same.

M.Termination:

SSS TECH has full right to terminate the service agreement with service provider on non performance / poor performance. as like drop the Posting ,offer, rating review, will be decreases of the service provider. suspend the Service provider Account; and additionally . Even fines can be depending on the situation.. 10.1. On nonpayment of necessary service charges to SSS TECH on time. 10.2. On violation of service agreement norms. 10.3. Unprofessional behave with SSS tech officials and customer.

N.Privacy Policy:

SSS TECH treats the privacy seriously. Service provider will follow our privacy policy. We collect the personal data for in connection with the platform and services. Service provider will act accordingly as per norms of Govt. of India.

O. Intellectual Property rights:

‘Content ‘ means all the documents, information, datas available on dorkar.in platform including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like (“Data”) and the trademarks, service marks and logos are owned by SSS TECH. Intellectual Property Rights” means all present and future rights anywhere in the world in relation to copyright, trademarks, designs, patents or other proprietary rights, or any rights to registration of such rights whether existing now or in the future. The Platform Content is protected by copyright and SSS TECH reserves all Intellectual Property Rights which may subsist in the Platform Content and/or the Platform.
