                                                                 TERMS OF SERVICE FOR LOCAL DIRECTORY LISTING

INFORMATION DISSEMINATION 

The dorkar.in presently communicates with users via a variety of platforms, including phone, internet, WAP (Wireless Access Protocol), Wireless (SMS short code), SMS, and Whatsapp. The dorkar.in reserves all the rights, in its sole discretion, to stop providing Information on any of the aforementioned platforms, or to provide Information on other platforms, or to change the method in which Information is supplied on any of the existing platforms, as it sees fit.

SUBSCRIPTION

Business membership may be business houses, small medium enterprises, corporate entities, semi-corporate entities, establishments or individuals, who subscribe to the Service in order to list their company or business. The dorkar.in will provide only the information about the services listed to the users in the manner provided in Terms and conditions. The service providers/businesses providers listed agrees and acknowledges that dorkar.in does not guarantee any business for them.

MEMBERSHIP

Your dorkar.in membership will remain active until you cancel it. You must have Internet connectivity and a dorkar.in ready device to use the dorkar.in service, as well as supply us with one or more Payment Methods. “Payment Mode” refers to a current, valid, and accepted method of payment, as updated from time to time, and may include payments made through a third-party account. Unless you cancel your membership prior to your billing date, you authorise us to charge your Payment Method for the membership price for the next payment.

BUSINESS MEMBERSHIP LISTING

Dorkar.in will provide packages to Vendors as part of a promotional strategy, subject to the terms outlined in the terms of service. In the business membership listing, dorkar.in will display the “Verified” emblem. The verified logo will be visible as long as the Vendor’s business listing is operational on Dorkar.in portals, subject to the terms of use and periodic telephonic or other verification procedures of the listing by Dorkar.in representatives. In the event of Vendor’s inability to honour the payment for listing packages, Dorkar.in shall not be accountable in any way to supply the services or otherwise. 

This refers to the various kinds of Listings of Services that can be selected by the business or services listed. dorkar.in provides the following kinds of listings Service (“Listings”):

SELLING

As a merchant, you must list product(s)/service(s) for sale or for providing service on the Platform in compliance with the policies with reference to the Terms of Use by way of reference. You must be legally able to sell the product(s)/service(s) you advertise for sale on our Platform, as well as possess all applicable licenses and permits. You must guarantee that the items on the list do not infringe on third-party intellectual property, trade secret, or other proprietary rights, as well as rights of publicity or privacy. Only text descriptions, graphics, photographs, or videos that describe your item for sale are permitted in listings. All objects must be listed in an orderly fashion on the platform in the right category to be successful, all of the things on the list must be kept in stock for the provision of services The description for listed items must not be misleading and must accurately depict the product’s or service’s current status. Dorkar.in maintains all the rights to remove any listing at any time at its exclusive discretion, of such products / services listed by you if needed.

BILLING AND CANCELLATION

The owner of services/businesses listed  agrees/undertakes to pay a non-refundable Listing/Service Fee in advance, as well as any other relevant charges/fees for any additional feature/upgraded services/facility, etc. that the services listed  may make available from time to time. The dorkar.in will determine the applicable charges/commercials fees in its sole discretion. The dorkar.in will send the e-invoice to the registered mobile number and email ID of the respective Vendor or their authorized person on their registered contact details upon receipt of such fees from the Vendor. The dorkar.in retains the right to recoup any related fees, costs, expenses, or taxes at any time if needed.

UPDATING YOUR PAYMENT METHODS

Go to the “Account” tab to make changes to your Payment Methods. We may also use information given for payment by service providers to update your Payment Methods. Henceforth you permit us to continue charging on the applicable Payment Method after any modification (s).

CANCELLATION

You can cancel your dorkar.in membership at any time, and you will continue to have access to the dorkar.in service through the end of your billing period. To the extent permitted by the applicable law, payments are non-refundable and we do not provide refunds or credits for any partial membership periods or unused dorkar.in content. To cancel, go to the “Account” page and follow the instructions for cancellation. If you cancel your membership, your account will automatically close at the end of your current billing period. To see about your account closer, click “Billing details” on the “Account” page. If you signed up for dorkar.in using your account with a third party for Payment Method and wish to cancel your dorkar.in membership, you may need to do so through same third party, for example by visiting your account with the applicable third party and turning off auto-renew, or unsubscribing from the dorkar.in service through that same third party.

CHANGES TO THE PRICE AND SUBSCRIPTION PLANS

We may change our subscription plans and the price of our service from time to time; however, any price changes or changes to your subscription plans will apply no earlier than 30 days following notice to you.

NO GUARANTEE OF BUSINESS

The dorkar.in does not guarantee that enquiries/leads will be generated by it for the services/businesses listed or that any of such enquiries/leads will be converted into business for the services listed. 

PROMOTIONAL OFFERS

We provide special promotional offers, programmes, or memberships from time to time (“offers”). The dorkar.in determines offer eligibility at its exclusive discretion, and we have the right to revoke an Offer and suspend your account if dorkar.in finds any discrepancies. Certain initial offers may not be available to members of same households with an existing or recent dorkar.in membership. To assess offer eligibility, we may use information such as device ID, payment method, or account email address associated with an existing or recent dorkar.in membership. When you sign up for the offer or receive any communications, you will be informed about the eligibility requirements as well as other limits and conditions.

• Dorkar.in will be at your service any time.

• You can optimize your business/ service through our platform to attain brand status in future.

INDEMNIFICATION

Business Listing shall defend, indemnify and hold harmless to SSS TECH.  and its affiliates and their officers, directors, employees, agents, successors, and assigns from and against all losses, damages, liabilities, deficiencies, actions, judgments, interest, awards, penalties, fines, costs, or expenses of whatever kind (including reasonable attorneys’ fees) arising out of or resulting from: (a) bodily injury, death of any person, theft or damage to real or tangible, personal property resulting from Business’s acts or omissions; and (b) Service provider’s breach of any representation, warranty, or obligation under this Agreement and the Service Agreement.

DECLARATION

You have read the required fields on the dorkar.in platform carefully and submitted accurate information to the best of your knowledge, and you understand that any misrepresentation or omission of information will result in your account being suspended.

Any refusal of payment or termination of your contract with dorkar.in  may be justified based on the circumstances. As a result, you agree to supply all persons or entities linked with dorkar.in  or our company’s name to dorkar.in the agent’s interest in you as a merchant on its Platform

You hereby affirm that the information or documents you supply to dorkar.in are, to the best of your knowledge, true and correct. You acknowledge and agree that dorkar.in may, in its sole discretion, institute and conduct a background check to verify the information provided by you herein at the dorkar.in site or platform, which may necessitate the disclosure of information to third parties and may result in the disclosure of personal information. You give dorkar.in permission to conduct such background checks, and you agree to submit any and all information requested by dorkar.in in this regard. You understand and agree that supplying incorrect information may result in dorkar.in delisting you from the platform and taking other actions as dorkar.in sees fit. Furthermore, you acknowledge that dorkar.in has the right to pursue all legal remedies available to it, including but not limited to you hereby affirm that the information or documents you supply to dorkar.in are, to the best of your knowledge, true and correct. You acknowledge and agree that dorkar.in may, in its sole discretion, seek compensation for damages from you for any loss incurred to dorkar.in a result of any inaccurate information you supply to dorkar.in

TERMINATION

The period of this contract begins with the registration or usage of the services/businesses and ends when either party terminates it (the “Term“). The listed business may only discontinue the service by giving 3 (three) months written notice (either by email or registered letter) prior to the automatic renewal of the same, expressing his intentions to terminate the service. The dorkar.in maintains all the rights, with or without cause, to terminate the service at any moment if the business named breaches a material duty due to dorkar.in, 

The dorkar.in may, at its discretion, require the owner of business listed to correct the breach within 7 (Seven) days after receipt of notice, failing which dorkar.in may terminate the connection between the business listed and dorkar.in.

The dorkar.in is not obligated to delist the business listed as a business listed or to stop disseminating information about the business listed to the users if the service is terminated. However, in the event of termination, dorkar.in reserves all the rights to delist the businesses mentioned without prior notice to the businesses listed. If there are any technical difficulties in continuing the services, dorkar.in reserves the right to terminate the services by informing the businesses listed in writing or orally. If the business listed terminates the service, either by efflux of time or by determination under these Terms of Service, the balance of the deposit placed with dorkar.in, if any, (after deducting payments for the period/tenure for which Services have already been provided) will be returned to the business listed. The dorkar.in will keep the information submitted by you. The listed businesses will not be entitled to get refund any money already paid to dorkar.in under any circumstances. If dorkar.in terminates the service for any cause that is solely due to dorkar.in, it will either repay the sums in a proportionate manner or provide alternative services. If a business listed on dorkar.in engages in fraud or other illegal or unethical activities, or if a business listed on dorkar.in engages in any activity that dorkar.in believes, in its reasonable judgment, is in violation of any laws that may be applicable from time to time or of accepted industry practice, and which could harm reputation or business of dorkar.in, The dorkar.in may terminate the service. The dorkar.in will immediately terminate this deal in connection with the occurrence of any of the events listed here.
